The Difference Between a Will, a Trust and Nothing — From Expert Mike Walters

In the clip below,  Mike Walters discusses the differences between a will, a trust, and nothing.  He explains that having nothing allows the state of California to take control of dividing your estate, without any input from your loved ones.   He clarifies that a will gives instructions to the probate court on what to do with everything you’re worked your whole life for.  However, this option include a probate process, one that can take a long time and will become very costly.

A trust allows you to make all of the decisions before hand, and does not give the government any input on how to divide your estate.  The option to use a trust permits you to act out your final wishes privately and secretly within your family.

Perhaps you are concerned with deciding between a will, a trust, and nothing.  By setting up a trust, you are in almost complete control of your estate.  Walters believes it is essential to be prepared for the future and that includes planning ahead.

“If you have a trust, then what you are saying is, you want to say what happens to everything you’ve worked your whole life for, with no government involvement whatsoever,” Walters explains. You can enact your wishes “privately and secretly within your family.”
